Children under 13 years of age are not permitted to use the Services for any purpose and LISNR does not collect personally identifiable information about children under the age of 13. Children under 18 years of age may only use the Services under the direction and guidance of a parent or guardian.
When you sign up for or use the Services, or use an application or platform that incorporates the Services you may voluntarily give us certain information about yourself, your organization and your employees. This can include name, address, phone number, email address and any other information you provide us. If you’re using the Services on your mobile device, you may also choose to provide us with location data. If authorized by you, we may also access profile and other information from services like Facebook, Twitter, Instagram or Foursquare. You agree not to provide us with any personal information regarding a third party unless you have the express informed consent of the data owner to share that information with LISNR for the purposes of accessing or using the Services.
Like most website operators, LISNR collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request when visitors use the Website or the Services. LISNR’s purpose in collecting non-personally identifying information is to better understand how LISNR’s visitors use the Services. From time to time, LISNR may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Website. LISNR also collects potentially personally-identifying information like Internet Protocol (IP) addresses and may collect statistics about the behavior of visitors to the Website. For instance, LISNR may monitor the Website to help identify spam.
In addition to log data, we may also collect information about the device you’re using to access the Services, including the type of device, the operating system, device settings, device identifiers and crash data. Flurry: Flurry Analytics provides accurate, real time data to developers about how consumers use their mobile applications, as well as how applications are performing across different handsets. Application developers receive anonymous, aggregated usage and performance data, as well as robust reporting and analysis tools. With this data, developers can identify issues and opportunities, create a more informed product roadmap, increase retention and grow their user base.
Google Analytics: Google Analytics is a web analytics tool that helps website owners understand how visitors engage with their website. Google Analytics customers can view a variety of reports about how visitors interact with their website so they can improve it. Google Analytics collects information anonymously. It reports website trends without identifying individual visitors.
LISNR ‘Smart Tone’ Technology
Certain third party applications utilize LISNR Smart Tone technology to create a more personalized experience for their end-users. Smart Tones are high frequency, inaudible sound waves that send data over audio and can trigger smart content and app experiences when registered by an end-user’s mobile device. We rely on the device microphone to detect and decode Smart Tone UUIDs and all Smart Tones are decoded on the local device. LISNR receives and buffers approximately ten seconds worth of audio. Once the data is processed and analyzed it is overwritten by new data and cannot be saved or recovered. Additionally, LISNR does not have the capability to deliver audio to a server, save or review audio minus the Smart Tone detection in any way.
We use the information we collect to provide you full access and functionality of the Services. Accordingly, your information may be used for the following purposes: (i) to provide and improve the Services, features and content; (ii) to administer your use of the Services and accounts; (iii) to enable users to enjoy and easily navigate the Services; (iv) to better understand your needs and interests; (v) to fulfill requests or to respond to questions or comments you may make; (vi) to personalize your experience; (vii) to provide you with announcements, notifications and advertisements related to your interests and use of the Services and other communications such as electronic newsletters, promotional e-mails or similar messaging; (viii) to provide service announcements; (ix) to protect against users seeking to hack into the Services; and (x) to assess the level of general interest in the Services.
Except as otherwise provided in this policy, we disclose the potentially personally-identifying information you disclose to LISNR only to those of our employees, contractors and affiliated organizations that (i) need to know that information in order to process it on our behalf or to provide the Services, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country and by using the Services, you consent to the transfer of such information to them.
Other than to its employees, contractors and affiliated organizations or as described above, absent your consent, we disclose personally-identifying information only when required to do so by law, or when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of LISNR, third parties or the public at large. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.
In addition, in some cases we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if LISNR or substantially all of its assets were acquired, or in the unlikely event that LISNR goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquiror of LISNR may continue to use your personal and non-personal information (user data) only as set forth in this policy. Otherwise, we will not rent or sell potentially personally-identifying and personally-identifying information to anyone.
Ad companies may use and collect anonymous data about your interests to customize content and advertising here and in other sites and applications. Interest and location data may be linked to your device, but is not linked to your identity.
You review and correct user data maintained by LISNR by signing into your account. You can also contact us by email to request to see this information.
We keep user data until you delete it. We remove personally identifiable information (such as your name, address, email or phone number) and other preferences associated with your account promptly after you delete your account. We may retain other data indefinitely.
We take reasonable steps to secure your personally identifiable information against unauthorized access or disclosure. We encrypt transmission of data on pages where you provide payment information. However, no security or encryption method can be guaranteed to protect information from hackers or human error.
A business subject to California Civil Code section 1798.83 is required to disclose to its California customers, upon request, the identity of any third parties to whom the business has disclosed personal information within the previous calendar year, along with the type of personal information disclosed, for the third parties’ direct marketing purposes.
